Overview of Skim Kemalangan Bukan Bencana Kerja (LINDUNG 24 JAM)

Statutory Framework and Participation Status under Act A1788

Effective 1 June 2026, LINDUNG 24 Jam came into force and contributions for June 2026 were mandatory for employees covered under the scheme. Following the Government’s decision on 8 July 2026, participation became voluntary for local employees while remaining mandatory for foreign workers. Local employees who wished to remain in the scheme did not need to take further action, while those who wished to opt out could do so from 13 July to 31 August 2026. Employees who opted in, or who did not opt out by 31 August 2026, remain covered while they continue to meet the applicable conditions under Act 4, in line with PERKESO’s “Sekali Layak, Terus Layak” (Once In, Always In) principle.

Furthermore, employees who previously opted out may subsequently opt in using PERKESO’s participation-status update process. Scope of Coverage: Bukan Bencana Kerja vs. Statutory Exclusions

Section 2(14A) of Act 4 defines a non-employment injury (bukan bencana kerja) as personal injury caused by an accident that does not arise out of and in the course of employment. In contrast, the Skim Bencana Pekerjaan provides protection for Kemalangan Semasa Menjalankan Pekerjaan, Kemalangan Semasa Dalam Perjalanan, Kemalangan Semasa Kecemasan, and Penyakit Khidmat.

Under LINDUNG 24 Jam, PERKESO covers accidents occurring in Malaysia, specifically including accidents at home, during personal travel, and during personal activities. However, statutory and administrative provisions specify certain exclusions:

Statutory Benefits Available under Skim Kemalangan Bukan Bencana Kerja

Income Protection: Faedah Hilang Upaya Sementara (FHUS) and Permanent Disablement

When an Insured Person suffers a qualifying non-employment injury, they may claim statutory financial compensation:

  • Faedah Hilang Upaya Kekal (FHUK): Permanent Disablement Benefit is assessed initially by the Medical Board (Jemaah Doktor). Claimants who disagree with an initial assessment may appeal to the Appellate Medical Board (Jemaah Doktor Rayuan).
  • Elaun Layanan Sentiasa (ELS): Constant Attendance Allowance of RM500 per month may be payable where an employee who has been assessed as permanently and totally disabled is severely incapacitated and requires the constant attendance of another person, based on the recommendation of the Jemaah Doktor, Jemaah Doktor Khas, or Jemaah Doktor Rayuan.

Medical & Rehabilitation: Faedah Perubatan and Bayaran Ganti Belanja (BGB)

Under Faedah Perubatan, an injured employee may receive free medical treatment at a PERKESO panel clinic or government clinic/hospital until fully recovered. For serious injuries, treatment must be obtained from a government hospital, where the employee is entitled to treatment in a second-class ward and specialist treatment where necessary.

For treatment charges incurred at a non-PERKESO panel clinic or private hospital, the employer or employee may submit a claim for Bayaran Ganti Belanja (BGB). Reimbursement is subject to rates determined by PERKESO or under the Fees Act 1951, at the corresponding government-hospital rate. Additionally, eligible claimants may access rehabilitation facilities. The scope of rehabilitation benefits depends on the employee category; PERKESO separately specifies the rehabilitation facilities available to foreign workers.

Survivors & Dependents: Faedah Orang Tanggungan (FOT), FPM, and Faedah Pendidikan

  • Faedah Orang Tanggungan (FOT): Eligible dependents may receive this benefit if the Insured Person dies as a result of a non-employment injury. The rates and shares payable to dependents are subject to the same conditions applicable under Skim LINDUNG Pekerja.
  • Faedah Pengurusan Mayat (FPM): For local employees, a benefit of RM3,000 is payable where an employee dies as a result of a non-employment injury or while receiving periodic Faedah Hilang Upaya Kekal payments. Payment is made to eligible heirs. If there are no eligible heirs, actual funeral expenses supported by receipts may be paid to the person who bore the expenses, subject to a maximum of RM3,000. Separate FPM provisions apply to foreign workers, as explained below.
  • Faedah Pendidikan: Educational Benefit may be available to eligible dependents under the applicable PERKESO benefit provisions, subject to PERKESO’s terms and conditions. PERKESO’s current foreign-worker guidance does not list Faedah Pendidikan among the benefits provided to foreign workers under LINDUNG 24 Jam.

Benefit Entitlements for Foreign Workers

Foreign workers are mandatorily covered under LINDUNG 24 Jam, but certain benefit provisions differ from those applicable to local employees. PERKESO’s current foreign-worker guidance specifically provides medical benefits, Bayaran Ganti Belanja, Faedah Hilang Upaya Sementara, Faedah Hilang Upaya Kekal, Elaun Layanan Sentiasa, physical rehabilitation facilities, Faedah Orang Tanggungan, and Faedah Pengurusan Mayat.

For foreign workers, funeral-related benefits may also include repatriation costs. Where death occurs in Malaysia and burial takes place in the worker’s country of origin, PERKESO currently provides for a maximum payment of RM7,500, including up to RM4,500 for repatriation and RM3,000 payable to the dependent, subject to the applicable conditions. Documents Required to Submit a LINDUNG 24 Jam Claim

Core Application and Supporting Medical Documentation

PERKESO requires a LINDUNG 24 Jam benefit application to be accompanied by supporting documents proving the accident and the treatment received for the injury. The exact forms and supporting documents depend on the benefit claimed and the method of submission:

  • Online Submissions: For an online Faedah Hilang Upaya Sementara (FHUS) application, PERKESO’s Portal LINDUNG Faedah user guide identifies the Sijil Cuti Sakit and Penyata Akaun Bank as mandatory supporting documents and states that a Laporan Polis Kemalangan should also be uploaded “sekiranya ada”.
  • Physical Submissions: For counter submission, the latest Borang 34 (Butiran Notis dan Tuntutan Faedah) includes a specific “Notis Kemalangan Bukan Bencana Kerja” option. The completed form should be submitted together with the applicable supporting documents required for the benefit claimed.

Employment Status and Multi-Employer Contribution Verification

Employers and employees must ensure employment records are accurate during claim verification:

  • Active Employment & Unpaid Leave Verification: Employers verify active employment and unpaid-leave status.   • Single Contributing Employer Rule: An employee working for more than one employer must select only one employer through which the LINDUNG 24 Jam contribution is made. If the employee does not make a selection, PERKESO will determine the contribution arrangement according to the manner and time prescribed by PERKESO. Method 1: Online Submission via Portal LINDUNG Faedah

Applicants can file electronically using the official portal workflow:

  1. Log in to Portal LINDUNG Faedah.
  2. Under Permohonan Faedah, click Permohonan Baru.
  3. Under Jenis Permohonan, select Kemalangan: Hilang Upaya Sementara (HUS) where applicable.
  4. Complete the following:
    • Maklumat Orang Berinsurans, Maklumat Majikan, Maklumat Kemalangan, and Maklumat Akaun Bank OB

HR Responsibilities and Statutory Compliance

Verification Role for HUS Applications

For an online Faedah Hilang Upaya Sementara (HUS) application, the application is submitted by the Orang Berinsurans (OB) for themselves. The employer subsequently receives a “Pengesahan Majikan” email through the email address registered in Portal ASSIST. The employer representative must review the application and complete the employer verification through the link provided by PERKESO.

Salary Treatment During Temporary Disablement

For employees covered by the Employment Act 1955, Section 60F(4) provides that an employee is not entitled to paid sick leave for any period during which the employee is receiving periodical payments for temporary disablement under the Employees’ Social Security Act 1969 [Act 4].

Employers should also take into account the applicable labour legislation in Sabah or Sarawak, where relevant. Furthermore, the person entitled to receive payment depends on the benefit claimed. When should an Insured Person submit a LINDUNG 24 Jam claim?

An Insured Person should submit a claim promptly after receiving certified medical leave. Section 44C of Act 4 provides that an Insured Person who suffers disablement from a qualifying non-employment injury is eligible, subject to the Act, for the same benefits available for an employment injury. Under PERKESO’s rules for Faedah Hilang Upaya Kekal (FHUK), the claim must be submitted within 12 months from the last date of temporary disablement.

How does Section 96 govern overlapping claims with other PERKESO schemes?

Section 96 of Act 4 provides that an Insured Person or dependent cannot receive the same or similar benefits under Act 4 and another Act administered by PERKESO for the same period and in respect of the same or related disablement, invalidity or death. Where entitlement to both benefits arises, the Insured Person or dependent may choose which benefit to receive for that period, and that decision is final.

Can private insurance be claimed alongside PERKESO LINDUNG 24 JAM?

Section 96 does not address private insurance. It regulates overlapping benefits under Act 4 and other Acts administered by PERKESO. Whether a separate claim can be made under a private personal accident or medical insurance policy depends on the terms and conditions of that policy.
